Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using https://dpsrecords.com website ("Service") and purchasing ("Order", "Orders", "Purchase", "Purchases") a Texas Driving Record ("Driving Record"), operated by DPS Records, LLC. ("Company", "us", "we", or "our"). The entity issuing the Order, and any affiliates, subsidiaries, successors or assigns thereof shall hereby be referred to as ("Buyer", "You", or "Your", "I"). Your access and use of Service, and/or Order is conditioned on Your acceptance of, and compliance with, these Terms. These Terms apply to all visitors, users, others who have access to our Service and Orders. By accessing, or placing an Order for Your Driving Record, You agree to be bound by these Terms. If You disagree with any part of the Terms, then you may not access the Service, or place an Order for Your Driving Record.

Refund/Cancellation Policy

A full refund will be made to any Buyer who cancels the Order before the fifteenth day after the Order is placed by the Buyer, unless the Company has successfully processed the Driving Record. Successful process is defined as the Company has emailed or mailed the driving record to the Buyer. The Order is considered successfully processed even if the email is rejected, sent to your junk mail folder, is non deliverable for any reason to the Buyer's email address. They Company will attempt to contact the Buyer over the phone if the email or mail is rejected for any reason. In instances of orders that are physically mailed, a parcel that is returned due to incorrect address, or is non deliverable will still be considered successfully processed. However, the Company will make every effort possible to ensure proper delivery. For cancellation of Order, please e-mail at support@dpsrecords.com with your full name, address, date you placed the Order, a brief statement of your cancellation request, and the last 4 digits of the credit card used to sign up. You may also submit this information at the secure form: https://dpsrecords.com/contact-2. Refunds will be processed on each Tuesday and Friday of each week, unless those days fall on a Federal Holiday. After refund has been processed, it may take up to 7 business days for the money to be returned to your account. If you have not received your money within 7 days, please contact support@dpsrecords.com.

Company will not be responsible if the incorrect Driving Record is purchased by the Buyer. No refunds will be given for incorrect Driving Record Types ordered. At it's description, Company may give a replacement record at a discounted rate.

If Company cannot process Driving Record for ANY reason, a full refund may be requested by the Buyer ("Money Back Guarantee"). The Company is not responsible for rejected email, mail, overnight deliveries for any reason. The Order is considered successfully processed even if the email is rejected, sent to your junk mail folder, is non deliverable for any reason to the Buyer's email address. They Company will attempt to contact the Buyer over the phone if the email or mail is rejected for any reason. In instances of orders that are physically mailed, a parcel that is returned due to incorrect address, or is non deliverable will still be considered successfully processed. However, the Company will make every effort possible to ensure proper delivery. Company will attempt to contact Buyer within 14 days of Order to correct any missing or incorrect information that has caused Order to not be accepted by the Texas DPS. Buyer may request refund within the first 14 days after Order is placed to request a refund with no questions asked. After 14 days of Order, the Money Back Guarantee will no longer be valid, and NO refunds shall be processed. You agree by placing an Order, if you wish to receive a refund, you will request it within 14 days of placing Order.

Privacy

The above named Company does not collect personal information for any purpose other than to process the Driving Record with the Texas DPS, and future Company marketing purposes. Moreover, the Company does not give/sell information to any private organizations. Statistical and anecdotal information may be used for research or to help clarify specific driving record information.

Limitations of Liability

To the extent permitted by law, in no event shall Company, its affiliates, its licencors, its suppliers or any third parties mentioned at the Service be liable for any incidental, indirect, exemplary, punitive, consequential damages, court fees, insurance increases, lost profits, or any other monetary increases resulting from the processing and/or delivery of Driving Record. In addition, Company shall not be held liable from the use of or even possible inability to use the website, systems educational information provided, services or the content whether based on warranty, contract, tort, delict or any other legal theory, and whether or not Company is advised of the possibility of such damages. To the extent permitted by law, the remedies stated for you in these terms of use are exclusive and are limited to those expressly provided for in these terms of use. DPS Records, LLC. cannot be held liable for any failure to perform any term or condition of this agreement as a result of conditions beyond its control, such as, but not limited to; war, strikes, fires, floods, acts of God, governmental restrictions, power failures or damages or destruction of any network facilities or servers and shall not be deemed a breach of this agreement. The company shall also not be liable for last minute requests by the Buyer. Time sensitive requests are the Buyers responsibility

Incorrect Driver License/Address Information

It is your responsibility to fill out all information completely and accurately to the best of Your Knowledge. If the DPS rejects your application for Driving Record, you WILL be eligible for a full refund within 15 days of placing the Order. Written request for cancellation/refund must be given. Please see the above cancellation policy for full details. If incorrect e-mail address or physical address is entered, Company will NOT issue a refund for the Order.
